Welcome to FreshMeat4U. These Terms and Conditions ("Terms") govern your access to and use of the FreshMeat4U platform, including our website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
FreshMeat4U is a meat delivery platform operating in Vadodara, Gujarat, India. We connect customers with local, FSSAI-certified meat shops for the delivery of fresh mutton, chicken, fish, seafood, and eggs. The platform is owned and operated by FreshMeat4U.com.
2. Definitions
- "Platform" refers to the FreshMeat4U website, mobile app, and all associated services.
- "Customer" means any individual who places an order through the Platform.
- "Shop" or "Vendor" refers to a registered meat shop or vendor listed on the Platform.
- "Rider" or "Delivery Partner" refers to the delivery personnel who fulfill order deliveries.
- "Products" refers to all meat, poultry, seafood, and egg items listed for sale on the Platform.
- "Order" means a purchase request placed by a Customer through the Platform.
3. User Eligibility
To use the Service, you must be at least 18 years of age and a resident of India. You must provide accurate, current, and complete information during registration and ordering. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 4. Account Registration
Certain features of the Platform may require you to create an account. When registering, you agree to provide truthful and accurate information. You must not create accounts using false information or impersonate any person or entity. We reserve the right to suspend or terminate accounts that violate these Terms or that are associated with fraudulent activity. Each individual is permitted to maintain only one active account at a time.
5. Orders and Pricing
5.1 Product Listings
All product listings on the Platform are provided by registered Shops. While we make every effort to display accurate product information, including weights, prices, and availability, actual products may vary slightly in appearance, weight, and cut due to the natural nature of fresh meat. Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
5.2 Order Placement
When you place an order, you are making an offer to purchase the selected Products. Order confirmation is subject to product availability and acceptance by the Shop. We reserve the right to decline or cancel any order for reasons including but not limited to: product unavailability, incorrect pricing, suspected fraud, or delivery area restrictions. Currently, FreshMeat4U delivers only within Vadodara, Gujarat.
5.3 Pricing Changes
Prices for Products may change without prior notice. The price applicable to your order will be the price listed on the Platform at the time of order placement. In the event of a pricing error, we will notify you and offer the option to confirm the order at the corrected price or cancel it.
6. Payment Terms
Payments are processed through Razorpay, our authorized payment gateway partner. We accept UPI, credit cards, debit cards, net banking, and popular mobile wallets. All payment transactions are encrypted and secure. The total amount charged will include the product subtotal, applicable platform fees, and delivery charges as displayed at checkout.
Cash on Delivery (COD) may be available for select orders. For COD orders, the rider will collect the exact payable amount at the time of delivery. Refusal to pay for a COD order may result in account suspension and restriction from future COD orders.
7. Delivery
7.1 Delivery Area
FreshMeat4U currently delivers only within Vadodara city limits, Gujarat. Delivery coverage may expand to additional areas at our discretion. You can check delivery availability by entering your address during the ordering process.
7.2 Delivery Timeline
We strive to deliver orders within the estimated time displayed at checkout. However, delivery times are estimates and may vary due to factors such as order volume, traffic conditions, weather, shop preparation time, and other unforeseen circumstances. We are not liable for any delays caused by factors beyond our reasonable control.
7.3 Delivery Responsibility
The responsibility for the Products transfers to you upon successful delivery at your designated delivery address. You or your authorized representative must be available to receive the order. If no one is available after multiple delivery attempts, the order may be cancelled and a cancellation fee may apply.
8. Quality and Freshness Guarantee
All Shops on the Platform are required to hold valid FSSAI licenses and must comply with food safety regulations. Our delivery process uses insulated packaging to maintain product temperature and freshness during transit. If you receive a product that does not meet our quality standards, you may request a replacement or refund as per our Refund and Cancellation Policy. Quality-related complaints must be reported within 30 minutes of delivery with photographic evidence.
9. Cancellation and Refund
Cancellation and refund requests are governed by our Refund & Cancellation Policy. In summary, orders may be cancelled before the Shop begins preparation. Once preparation has started, cancellation is subject to Shop approval. Refunds for eligible cancellations and quality issues will be processed within 5-7 business days to the original payment method. 10. User Conduct
When using the Service, you agree NOT to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
- Provide false, misleading, or inaccurate information during ordering or account registration.
- Attempt to interfere with or disrupt the Platform's operation, servers, or networks.
- Harass, threaten, or abuse Shop owners, delivery riders, or other customers.
- Reverse-engineer, decompile, or disassemble any part of the Platform.
- Place fraudulent orders or use stolen payment instruments.
- Use automated systems, bots, or scrapers to access the Platform.
Violation of these conduct rules may result in immediate account suspension or termination, and we may pursue legal action where appropriate.
11. Intellectual Property
All content on the Platform, including but not limited to logos, trademarks, service marks, text, graphics, images, software, and the overall design of the Platform, is the property of FreshMeat4U.com or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent. The FreshMeat4U name, logo, and all related marks are trademarks of FreshMeat4U.com.
12. Limitation of Liability
To the maximum extent permitted by applicable law, FreshMeat4U, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages for loss of profits, data, goodwill, or other intangible losses. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
FreshMeat4U acts as an intermediary platform connecting Customers with Shops and Delivery Partners. We do not guarantee the quality, safety, or legality of Products sold by Shops, nor do we endorse any particular Shop. Product quality and safety are the responsibility of the respective Shop.
13. Indemnification
You agree to indemnify, defend, and hold harmless FreshMeat4U, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements including legal fees arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
15. Dispute Resolution
Any disputes arising out of or in connection with these Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Vadodara, Gujarat. Before initiating legal proceedings, you agree to attempt to resolve any dispute through our internal Complaint Resolution process. We are committed to resolving amicably and will respond to all complaints within the timelines specified in our Complaint Resolution policy.
16. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on the Platform. We will make reasonable efforts to notify you of material changes through in-app notifications or email. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. The remaining provisions of these Terms shall continue to be binding and enforceable.
